The presiding judge retired and another retired judge, James Hein, took over. He blew up the State's plea agreement with Jake Wagner and took the death penalty off the table for Billy Wagner, procedural botches that have resulted i n rare appeals by the State, which generally has few appellate options in criminal cases.
